ATTACKING TUCSON’S BIG-BOX ORDINANCE…
Stymied by Tucson, Arizona’s, big-box ordinance, Wal-Mart is circulating petitions to repeal a portion of the law restricting food and beverage sales to no more than 10 percent of a store’s total space.. The company only needs 11,615 signatures to get on the ballot.
Opponents are already seeking to block the move from ever reaching a vote.
According to the Arizona Daily Star:
John Moshier, an attorney representing the local chapter of the United Food and Commercial Workers Union, said he would seek an injunction against putting the initiative on the November ballot on the grounds that it runs afoul of a state law forbidding initiatives on rezonings or to amend the text of a city’s general plan, which would apply to Tucson’s big-box ordinance, he said.
“The voters do not have the power as a matter of law to pass the initiative that Wal-Mart is circulating,” Moshier said.
Voters, given sufficient political will, do have the power to change any law they don’t like. That’s how Democracy works.
